8. ON ORDER, PROTECTION AND TRAFFIC IN THE PORT TERRITORY

8.1. PROTECTION OF SHIPS AND PORT FACILITIES

8.1.1. Within the framework of execution of the requirements of the International Ship and Port Facility Security Code (ISPFSC) a constantly operating system of security measures has been developed by Port. Such system includes:

  • Organization of the Port territory protection and provision for checked admittance to the Port territory;
  • Establishment of Maritime Security Service (MSS) Post on board of conventional ships and interaction: Ship Safety Officer – MSS Post – Maritime Security Unit (MSU) Officer;
  • Organization of round-the-clock watching of ships and Port structures by MSU Posts and by means of technical video surveillance facilities; and
  • Involvement, if required, of quick reaction force and facilities.

8.1.2. All organizations and ships flying any flag that arrive at Port, irrespective of their possessing International Ship Security Certificate, shall operate in Port in compliance with the requirements of the ISPFSC and according to the procedure established by the Port MSS.

8.1.3. Each ship, to which Ch. XI-2, SOLAS-74 extends, when staying in Port shall be surveyed by officials of the ISPS, the Port State Supervising Inspection (PSSI) and officers of the MSU.

8.1.4. If there are reasonable grounds to consider that ship does not satisfy the requirements of Ch. XI-2, SOLAS-74 and Section A, ISPFSC, or if at request of the ISPS and PSSI officials ship produces no valid International Ship Security Certificate or valid Interim International Ship Security Certificate or Ship History Continuous Registration Log, the following measures may be applied to such ship:

  • Ship check up or more detailed survey;
  • Ship arrest;
  • Limitation of operations including shifting in the Port territory;
  • Exclusion from Port; or
  • Additional or alternative administrative sanctions according to the standing legislation of Ukraine.

8.1.5. Each ship, within 72 hours prior to her approach, shall submit to the Port MSU standard list of security information.

8.1.6. If required the Port MSU may request additional information.

8.1.7. Should ship submit delayed and/or incomplete information, such ship may be refused issuance the permit for entering Port or it may serve as reasonable grounds for subjecting such ship to more detailed survey by officials of the MSU, ISPS and IDSC.

8.1.8. Should there be (an) illegal passenger(s) on board the ship that is about to enter Port, such ship, in addition to the information provided by Cl. 8.1.5 herein above, shall submit information about each illegal passenger required according to Resolution A.871(20), IMO.

8.1.9. All ships that enter Port shall be equipped with an on-board alarm system.

8.1.10. For the purpose of provision for continuously operating system of security measures in Port and within the framework of compliance with the requirements of the ISPFSC Ship Master of a conventional ship shall use the MSU services concerning posting permanent security guard on the ship, which shall be paid according to the established tariffs (only conventional ships possessing a regular service of ship’s maritime security on board may be an exception). Arrangement of such post is executed through agency firm.

8.1.11. Should a non-conventional ship or the ship sailing under the of a country, which is not member to SOLAS-74 Convention, obtain permit for entering Port, such ship shall subscribe Declaration of Security with the MSU and accept contractual terms of the ship’s guarding by the MSU in accordance with the approved procedure and established tariffs.

8.2. CHECK-IN SYSTEM AND PORT SECURITY

Check-in System

8.2.1. The SCPI is a maritime international check-in point of crossing state border, where border customs zones are located. Port is a guarded facility and its check-in system must satisfy the requirements of reliability of the state border guarding. The territory and water area of the SCPI, within the established limits, are restricted areas and are protected by Security Service of the SCPI and Sub-Unit of Commandant’s Office of Boundary Detachment. All requirements as to the Port admission regime are regulated by Provision “On Check-in System and Regime of the SCPI” approved by Order issued by Port Manager.

8.2.2. Pedestrians and road transport are admitted to Port through Control Posts:

  • CP-1 (the Main Control Post located opposite Pier no. 6);
  • CP-2 (the Second Control Post located opposite Pier no. 11);
  • CP-3 (Control Post of SVK ALDI);
  • CP-4 (the Third Control Post located opposite Pier no. 24);
  • CP-5 (Control Post of Ferry Passenger Complex); and
  • CP-6 (Control Post of Multimodal Complex, located opposite Pier no. 27).

The Pass Bureau of the Security Service Documents Execution Department has its units in all Port Control Posts.

8.2.3. All persons that are in the restricted territory of the Sea Commercial Port of Ilichevsk shall have Port Passes of the established form or other documents that give them the right of staying in the Port territory and produce them at first request of the Port Security Service and Sub-Unit of Commandant’s Office of Boundary Detachment.

Persons possessing Passes without photographs (Passes for one occasion or Temporary Passes) shall produce documents identifying their personality.

8.2.4. On the basis of the ISPFSC requirements and for the purpose of providing for ship security and control over visiting persons, who are not members of crew, Ship Master shall organise watches at the boarding ladder for a whole period of ship’s stay in Port.

Such watch service on ship is inspected by representatives of Border Force and representatives of the ISPS.

8.2.5. Persons that are not crew members, except for crew members’ next of kin, may not live on ships.

Cargo Security

8.2.6. Security of ships staying in Port and cargoes on such ships is the responsibility of their ship owners.

8.2.7. Open sites, where cargo may temporarily be piled, which are subject to protection of Security Service, must be sufficiently illuminated and provided with guard railing.

8.3. TRANSPORT CIRCULATION AND PARKING AND PEDESTRIAN CIRCULATION

8.3.1. Speed of transport circulation in the Port territory is regulated by means of road signs, marking, signal lights and other established facilities and exceeds: 30 km/h on trunk-roads, 6 km/h on major roads and 3 km/h on passages, side-tracks and platforms.

8.3.2. Entry of road transport to the Port territory is regulated by Order of Port Manager.

8.3.3. Circulation of pedestrians is regulated by designated routs. Personnel of foreign ships crews may only enter/leave Port via the Main Control Post.

8.3.4. Shunting railway transport must move in the Port territory with a speed of 5 km/h, not over and warn by signaling about their approaching crossings. The person making up a train shall check road condition and availability of free space for passing of the cars in good time.

8.4. PASSENGER OPERATIONS IN PORT

8.4.1. Passengers are carried to ships anchored in the Port water area or on the outer roads from Piers nos. 1, 11 and 18 and the PF Pier. Dwelling beside the above piers may only be permitted during embarkation and disembarkation of passengers, except for the PF Pier.

Masters of regular estuary launches shall check tickets of passengers, identify legality of their going to the roads and inform the CP about revealing the persons without the documents.

8.4.2. Passengers may be carried from Port to ships anchored on the outer roads provided visibility is at least 1 mile and roughness of the sea does not exceed 2 points.
